For example, we or our partners may use cookies and tracking technologies to collect information about your interactions with our website and ads, so that we can show you relevant promotions.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information only as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law.

We will retain your personal information for as long as it is needed for the purposes outlined in this Privacy Policy, unless a longer period is required by law (for example, for tax, accounting, or legal compliance). In general, this means:

  • Contact and account information is kept as long as you have an account or an ongoing relationship with us.

  • Transaction data is kept for the duration needed to complete the transaction and for a reasonable period thereafter (to handle any returns, refunds, or legal issues), or as required by law (e.g., retaining purchase records for tax purposes).

  • Marketing information is kept until you unsubscribe or ask us to delete it (or after a defined period of inactivity). If you opt out of marketing communications, we will remove your contact from our marketing lists, though we may keep a record of your preference not to be contacted.

  • Browser and device data (collected via cookies) is kept according to our cookie policy or as long as necessary for analytics purposes, typically on the order of months, unless you clear those cookies or opt out sooner.

When we have no ongoing legitimate business need to use your personal information, we will delete or anonymize it. If immediate deletion is not possible (for example, because the data is stored in backup archives), then we will securely store the data and isolate it from further use until deletion is feasible.

Please note that even after you delete your account or ask us to delete your information, we may retain certain information as necessary to comply with legal obligations, resolve disputes, enforce our agreements, or as otherwise required or permitted by law.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational measures to protect the security of your personal information. These include measures such as encryption of sensitive data (e.g., using SSL/TLS for data transmission), access controls to databases, and policies to ensure employees handle data securely. We also limit access to personal information to those employees, contractors, and agents who have a business need to know.

While we strive to protect your information, please understand that no security system is 100% infallible. No method of transmitting data over the Internet or storing data is completely secure. Thus, we cannot guarantee that unauthorized third parties (hackers, cybercriminals, etc.) will never be able to defeat our security measures or misuse your data. You share and transmit information at your own risk. We recommend that you use secure networks to access our Services and that you keep your account credentials confidential.

If we become aware of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law.

7. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect or market personal data from children under 18 years of age.

Our Services are not directed to individuals under 18. We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 (or that you are the parent or guardian of a minor who is using our Services with your consent). If we learn that we have collected personal information from a user under 18 without parental consent, we will take reasonable steps to delete that data as soon as possible. This may include deleting the child’s account or restricting access to certain parts of the Services.

8. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time. Depending on your location, you have certain rights to access or control your personal information.

If you are located in certain regions (such as the European Economic Area, United Kingdom, or specific U.S. states), you may have specific rights under applicable data protection laws. These may include the right to (i) request access to your personal data, (ii) correct or rectify your data, (iii) delete your data, (iv) restrict or object to certain processing of your data, and (v) data portability (obtaining a copy of your data in a machine-readable format). We describe these and additional rights for California residents in Section 10 below.

You have the right to withdraw your consent at any time. However, this will not affect the lawfulness of any processing carried out before the withdrawal of consent.

EEA/UK Residents: If you are in the EEA or UK, you have the right to complain to your local data protection supervisory authority if you believe we are unlawfully processing your personal information. We encourage you to contact us first with any concerns, so we can address them.

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw that consent at any time. For example, you can withdraw consent to marketing emails by unsubscribing, or consent to push notifications by adjusting your device settings. Please note that withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, and in some cases we may have other legal grounds to process your data (such as fulfilling a contract with you or complying with a legal obligation).

Opting out of marketing communications: As mentioned, you can opt out of marketing emails at any time by clicking the “Unsubscribe” link in those emails or by contacting us using the information at the bottom of this policy. For SMS/WhatsApp marketing messages, you can opt out by replying “STOP” to any message, or if that doesn’t work, by emailing us at support@imaree.com to request removal. Once you opt out, we will remove you from our marketing lists. Please note that even if you opt out of marketing, we may still send you service-related communications when necessary (for example, transactional emails about an order, or important notices about your account).

Account Information: If you have an account with us, you can log in to review and update certain information (like your contact details or password). If you would like to review or change the information in your account, or if you want to terminate your account, you can:

  • Contact us using the contact information provided at the end of this policy, and request that we deactivate or delete your account.

Upon your request to terminate your account, we will deactivate or delete your account and remove information from our active databases. However, please note we may retain some information in our files after your account is deleted, as permitted by law – for example, to prevent fraud, troubleshoot issues, assist with investigations, enforce our agreements, or comply with legal requirements.

Cookies and Do-Not-Track: You have the ability to control cookies as described in Section 4 above. Additionally, most web browsers and some mobile OS/apps include a Do-Not-Track (“DNT”) setting you can activate to signal your privacy preference not to be tracked online. However, there is currently no accepted universal standard on how to respond to DNT signals, and we do not respond to DNT browser signals or other similar mechanisms at this time. If a standard for online tracking is adopted in the future that we must follow, we will update this policy to inform you of our new practices.

We will process your requests to access, correct, or delete your data within 10 days (or as required by applicable law). If we need additional time, we will notify you with the reason for the delay.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

As mentioned above, Do-Not-Track (DNT) is a privacy preference you can set in some web browsers or mobile devices to signal that you do not wish to be tracked across different websites. Because there is not yet a uniform standard for recognizing or honoring DNT signals, our Services currently do not respond to these signals or similar mechanisms. We will monitor developments around DNT browser technology and if a standard emerges, we will adjust our practices accordingly and update this Privacy Policy.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes. If you are a California resident, you are granted specific rights regarding your personal information under California law, including the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights allow you to request more information about your personal data and give you greater control over how your data is used. We describe these rights below.

Shine the Light (California Civil Code §1798.83): California’s “Shine The Light” law allows California residents to request once a year, free of charge, a disclosure of what categories of personal information (if any) we have shared with third parties for their direct marketing purposes, and the names and addresses of those third parties. If you are a California resident and would like to make such a request, please send a written request to us using the contact information provided in Section 12 below. Please include in your request sufficient detail for us to locate your records (such as the email you used with us) and a statement that you are a California resident making a "Shine the Light" inquiry. We will provide the required information to you in accordance with California law.

California Minors (Removal of Public Information): If you are under 18 years old, live in California, and have an account with our Services, you have the right to request removal of content or information you have publicly posted on our Services. To request removal of such data, please contact us using the information below, specifying the content in question and confirming that you are the account holder. We will make sure the content is no longer publicly visible on our Services, or will anonymize it. Please note, however, that removal from public display may not completely delete the content or information from our systems (for example, data may remain in our backups or logs).

CCPA/CPRA Privacy Notice: The following disclosures are made pursuant to the California Consumer Privacy Act as amended by the California Privacy Rights Act. The CCPA requires us to inform California residents about the categories of personal information we collect, the purposes for which we use them, the sources from which we collect personal information, and whether we disclose or "sell" that information.   • Identifiers (Category A): Includes real name, alias, postal address, telephone or mobile number, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, and account name. Collected: Yes

  • Geolocation data (Category G): Includes precise geographic location information about a particular individual or device. Collected: Yes (we may collect general location from IP, but not precise GPS coordinates)

  • Audio, electronic, visual, or similar information (Category H): Includes audio, electronic, visual, thermal, or olfactory information (e.g., call recordings or CCTV footage if you visit a physical store, photographs you provide).   • Professional or employment-related information (Category I): Includes job history or performance evaluations. Collected: No (we do not actively collect this from customers, only if you voluntarily provide such info, which is rare)

Disclosure or sharing of personal information: In the last 12 months, we have not sold personal information to third parties for monetary consideration. We do not sell personal data in exchange for money. However, the CCPA/CPRA define “sale” and “sharing” broadly to include some transfers of data for advertising or other purposes. We only share personal information with third parties as described in this Policy (see Sections 3 and 4), and always for specified purposes such as providing our Services or advertising.

We have disclosed personal information to third parties for business purposes in the past 12 months, in the following categories:

  • Category A (Identifiers) – e.g., shared with service providers like shipping partners and payment processors for order fulfillment.

  • Category B (Customer Records info) – e.g., shared with our payment processor and fulfillment partners as needed to complete transactions.

  • Category F (Internet or network activity) – e.g., shared with analytics and advertising partners through cookies/pixels to analyze usage and serve ads.

  • Category K (Inferences) – e.g., shared in aggregate form with marketing partners to improve targeting of offers.

These disclosures are made for business or commercial purposes such as processing transactions, providing customer service, advertising, and improving our Services. We do not disclose categories C (protected characteristics), E (biometric), I (professional), or J (education) to third parties, as we do not collect those. Any information we disclose is only to service providers or partners under contract, as outlined in Section 3, and not for those third parties’ independent use except as needed to perform their services.

The categories of third parties to whom we have disclosed personal information are described in Section 3 (“When and with whom do we share your personal information?”) of this Policy. In summary, this includes service providers (like payment, fulfillment, and analytics companies) and certain marketing/advertising partners.

Your rights under CCPA/CPRA: If you are a California resident, the CCPA (as amended by the CPRA) grants you the following rights with respect to your personal information:

  • Right to Know: You have the right to request that we disclose to you the specific pieces of personal information we have collected about you, as well as details about our information practices. This includes the categories of personal information we have collected, the categories of sources of that information, the purpose for collecting or selling (if applicable) the information, and the categories of third parties with whom we share personal information. (Much of this information is provided in this Privacy Policy.)

  • Right to Delete: You have the right to request that we delete any personal information about you that we have collected and retained, subject to certain exceptions (for example, if the information is needed to complete a transaction you requested, to detect security incidents, for legal compliance, etc.). If you ask us to delete your personal information, we will honor your request and delete your data unless an exception applies. We will also instruct our service providers to delete your information from their records where required by law.

  • Right to Correct: You have the right to request correction of inaccurate personal information that we maintain about you. If you find that any of your information is incorrect or out-of-date, please contact us to request a correction.

  • Right to Opt-Out of Sale or Sharing: You have the right to opt out of the “sale” of your personal information or the sharing of your personal information for cross-context behavioral advertising. As noted, we do not sell personal data for money. If we engage in activities that are considered a “sale” or “sharing” under California law (such as certain cookie-based advertising), you can opt out by using the cookie preference tools on our site or by contacting us. Once we receive and confirm an opt-out request, we will stop selling or sharing your personal information as soon as feasibly possible, and no later than 15 business days from the date we receive your request.

  • Right to Limit Use of Sensitive Personal Information: If we collect any sensitive personal information (as defined by California law) for reasons beyond what is necessary to provide our goods or services, you have the right to direct us to limit the use or disclosure of that information to specific allowable purposes. (At this time, we do not collect or use sensitive personal information in ways that would trigger this right. We will notify you if this changes.)

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you services, charge you a different price, or provide a different quality of service just because you exercised your rights under the CCPA/CPRA. However, if you refuse to provide certain information or ask us to delete it, we may not be able to provide some services you requested (for example, we cannot ship an order to you without an address).

Exercising Your California Rights: To exercise any of the rights described above, please submit a verifiable consumer request to us by either: (1) emailing us at support@imaree.com, or (2) mailing your request to the address provided in Section 12 (Contact Us) below. Please specify which right you intend to exercise and provide us with enough information to verify your identity (for instance, your name, email, and any relevant account or order number). We will only use the personal information provided in a request to verify your identity or authority to make the request and to track and document request fulfillment.

Verification Process: For your protection, when you submit a request, we will take steps to verify that you are the individual (or an authorized agent of the individual) about whom we have collected personal information. The verification steps may vary depending on the sensitivity of the information and whether you have an account with us. We may ask you to provide information that matches what we have on file (such as confirming details of a recent purchase or providing a known piece of information like your email address). In some cases, we may contact you through a previously provided communication channel (e.g., email or phone) to confirm the request. If we cannot verify your identity from the information we have, we may request additional information solely for the purpose of verification. We will delete any new information you provide once we finish verifying you.

Authorized Agents: You may designate an authorized agent to make a request under the CCPA/CPRA on your behalf. If you choose to do so, we will require the authorized agent to provide proof of their authorization (for example, a written permission from you) and we may also require you to verify your identity directly with us or confirm that you provided the agent permission. We may deny a request from an agent who cannot provide proof that they have been authorized to act on your behalf.

Response Timing and Format: We aim to respond to verifiable consumer requests within 45 days of receipt. If we require more time (up to an additional 45 days, for a total of 90 days), we will inform you of the reason and extension in writing. If you have an account with us, we will deliver our written response to that account (otherwise, we will deliver it via mail or email, depending on your request). Any disclosures we provide will cover the 12-month period preceding our receipt of the request. If we are unable to fulfill your request in part or in full, we will explain the reason in our response (e.g., we could not verify your identity or the request is exempt from the law).

Other California Privacy Rights: In addition to the above, California law provides:

  • You may object to the processing of your personal information in certain situations (for example, if you feel our processing is not justified).

  • You may request correction of your personal data if you believe it is incorrect or no longer up-to-date, or request that we restrict processing of your information under certain conditions (for instance, if you contest the accuracy of the data).

  • You can designate an authorized agent as described to exercise requests on your behalf.

  • You may opt out of future “sales” of personal information to third parties as described above. Once we receive your opt-out request, we will act upon it as soon as feasibly possible (no later than 15 days) and refrain from selling your data going forward.

We will not charge you for making a request unless it is excessive, repetitive, or manifestly unfounded (in which case we may charge a reasonable fee or refuse to comply, as permitted by law). We will explain our decision if we refuse a request.

Financial Incentives: From time to time, we may offer programs or benefits that involve the collection or sale of personal information, such as a rewards program or a special discount in exchange for signing up for our marketing list. Under the CCPA, California consumers have the right to receive a clear description of any financial incentives a business may offer in exchange for personal information, as well as the terms of those programs.

If we offer a program that provides price or service differences (for example, a discount or coupon) tied to your provision of personal information (like your email for a newsletter signup discount), we will inform you of the material terms of the program at the time you sign up and obtain your consent to opt in. Participation in such incentive programs is entirely voluntary, and you may withdraw at any time.

In evaluating any financial incentive, we will establish and in good faith estimate the value of your personal information that forms the basis for offering the incentive, and we will use a method for calculating this value as required by law. We will disclose this value and method in the description of the incentive program. For example, if we offer a one-time discount for joining our marketing list, we might calculate the value of your contact information based on the expected spending of an average customer minus the cost of the discount offered.

If you join an incentive program, you have the right to withdraw at any time. To opt out of a financial incentive program, you can follow the instructions provided in the program terms (for example, unsubscribe from the marketing emails or ask to delete your account) or contact us at support@imaree.com. If you request to withdraw from an incentive, we will honor that request and will not penalize you (though you may lose access to the benefits of the program).

We currently offer the following financial incentive(s):

  • Email Newsletter Discount: We may provide a one-time coupon (for example, 10% off your first purchase) if you subscribe to our email newsletter. In this case, we collect your email address and possibly your name. The monetary value of this data is reasonably related to the value of the discount provided (based on our calculation of anticipated revenue from email subscribers). You can opt out by unsubscribing from the newsletter at any time (via the “unsubscribe” link in the email or by contacting us). After opting out, you will no longer receive the discount or promotional emails, but we will still honor any purchases you made using the discount.

  • SMS Marketing Club: If we run an SMS or WhatsApp promotions club (e.g., you sign up to receive texts and get a promotional offer), we will similarly disclose the terms and obtain your explicit consent (for example, by asking you to text a keyword to a number or check a box agreeing to receive texts). You can withdraw by texting “STOP” or contacting us, as described above, and you will not receive further texts but can continue to use our Services normally.

We do not offer different prices or services to consumers except in connection with actual cost differences or as allowed by law. We will never discriminate against a consumer for exercising privacy rights, even if they result in the consumer not participating in a financial incentive program.
